Who is Subject to HIPAA?

Virtually all physicians who have direct treatment relationships with patients are subject to the HIPAA Privacy Rule. You may be exempt only if you do not transmit any information in electronic form that relates to any of the transactions covered by HIPAA. Since these transactions include billing and claims, and participation in Medicare will require that you submit electronic claims, the reality is that few if any allergists will be excepted from application of the privacy regulations.

If you think you are an exception, please notify the JCAAI office in writing and we will have your reasons reviewed by our attorney.

  • Providers
  • Health plans
  • Health clearing houses
